What a PUD actually is, and why it is not a condo
A detached house in a gated Arizona community is almost always a PUD, a planned unit development, and a PUD finances like any other single family home. You own the lot and the structure. The association owns the gate, the streets, the wash, the ramada, and the landscaping along the entry.
That distinction matters more than anything else on this page. Condominium projects took real underwriting changes this year. Detached PUDs did not. When a buyer calls worried that the new condo rules are about to blow up a purchase in a gated community off Pima and Happy Valley, the answer is almost always no, because those rules address condominium projects and nothing else.
You can confirm which one you are buying in about five minutes. Pull the recorded declaration for the community from the Maricopa County Recorder. If it reads "Declaration of Covenants, Conditions and Restrictions" and describes numbered lots, you are in a PUD. If it reads "Declaration of Condominium" and describes units and airspace, you are in a condo. Arizona planned communities sit in A.R.S. Why project review is waived on most Arizona PUDs
Project review is waived for units in PUD projects. No questionnaire, no budget review, no owner occupancy ratio, no reserve study, no eligibility list to check your community against.
That is the single biggest reason a gated community purchase is easier than buyers expect it to be. There is no package sitting on an HOA manager's desk holding your file hostage while a rate lock burns down. The underwriter looks at you and at the house.
Three things still get checked, and they are the three that surprise people:
- The association's master insurance. Evidence that the HOA carries acceptable hazard and liability coverage on the common elements.
- Your dues. Counted in full against your debt to income ratio.
- The streets. If they are private, the appraisal has to say so and say who maintains them.
Private streets: the item that actually delays these files
If the community's roads are private, the appraiser has to address maintenance in the report and the underwriter has to see a legally enforceable arrangement to keep them maintained. In an Arizona planned community, the recorded CC and Rs are that arrangement, and in a normal file that is the end of it.
Here is where it goes sideways. Arizona has no statute that requires a separate recorded road maintenance agreement. Underwriters at lenders who write a lot of rural loans in states that do require one will sometimes condition the file for "the recorded private road maintenance agreement," and there is not one, because the declaration already imposes the maintenance obligation on the association and funds it through assessments. The fix is a page reference from the declaration plus the corresponding line in the HOA budget. That costs a day if your broker sends it up front and a week if the file bounces twice on the same condition.
This gets more attention in small enclaves, ten to thirty homes, where the association is really six neighbors and a shared drive, and less attention in a four hundred home community with a management company and a paving reserve. If you are buying into a small gated pocket in North Scottsdale or Paradise Valley, ask for the budget before you write the offer.
HOA insurance and dues, the two numbers underwriting cares about
Insurance first. The association carries a master policy on the common elements, and the underwriter wants evidence it exists and that the coverage and deductible are reasonable. Plenty of Scottsdale and North Phoenix associations have absorbed double digit premium increases over the last two years, and the common response has been to raise the deductible. An unusually high master deductible draws a condition, and occasionally it changes what your own policy has to look like. Now the dues, because this is where buyers lose the most house. HOA assessments count in full against your debt to income ratio. If the association bills quarterly, it gets divided. A 1,450 dollar quarterly assessment is 483 dollars a month of qualifying room gone, and at a 6.75 percent thirty year rate that 483 dollars is worth roughly 74,000 dollars of loan amount. Gated communities in the Valley frequently run there or higher once you add a guarded entry.
